Potentiality Terms of Use for the Shore Career Assistant Directory

1 Introduction
These Terms of Use ("Terms") govern your use of the Shore Mentor Register (the "Register"). By using the Register, you accept these Terms in full. In addition to these Terms, you shall comply with any rules or guidelines for use of the Register provided to you by the Association from time to time.

2 The Register

2.1 The role of Potentiality Pty Ltd ("Potentiality"), Sydney Church of England Grammar School (the "School") and the Shore Old Boys Union (the "Association") in providing the Register is solely to act as a facilitator to enable people who agree to become mentors ("Mentors") to pass on their knowledge and expertise to members of the Association ("Mentees") and its community.
2.2 Whilst every effort has been taken to ensure the accuracy of the information provided on the Register (and to correct any errors or omissions within a reasonable period of time after being notified of them), neither Potentiality nor the Association guarantees that the Register will be accurate, complete, reliable, current or error-free.
2.3 Material on the Register may be changed, modified or removed at any time without notice.
2.4 Whilst reasonable endeavours will be made to allow uninterrupted access to the Register, access to the Register may be suspended, restricted or terminated at any time.

3 Limitation of liability
To the fullest extent permitted by law:
3.1 all warranties, terms, conditions and representations (whether express or implied) relating to the Register and the use of the Register (including, without limitation, any warranties implied by law for the use of reasonable care and skill) are excluded; and
3.2 all liability and responsibility on the part of Potentiality and the Association (and any of their officers, directors, employees, shareholders, related companies or agents) for any loss or damage that may be incurred by any Mentor, Mentee, other member of the Association or any third party, including without limitation any direct, indirect, punitive, consequential or special loss or damages, and whether in tort (including, but not limited to, negligence), contract or otherwise in connection with:

(a) the Register;
(b) the use, inability to use or the results of use of the Register;
(c) any sites linked to the Register or the material on such sites; or
(d) your downloading of any material from the Register or any sites linked to the Register;

is hereby excluded.

4 Privacy
4.1 Only the gender, age, profession and work experience of a Mentor will be displayed to other users of the Register until the Mentor agrees to disclose their name and contact details to a particular Mentee.
4.2 A Mentor may update their details or discontinue their involvement with the Register at any time by emailing the site administrator or info@ptly.com.
4.3 Use of personal information by the Register will comply with all applicable privacy laws, and otherwise in accordance with Potentiality’s privacy policy which can be viewed at www.ptly.com.

5 Miscellaneous
5.1 These Terms may be revised from time-to-time. Any revised Terms will apply to the use of the Register from the date of the publication of the revised Terms on the Register. A note will be placed on the Register if the Terms are revised.
5.2 If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and where capable the validity and enforceability of the remaining provisions of these Terms shall not be affected.
5.3 These Terms will be governed by and construed in accordance with the law which applies at the principal place of business of the Association, and any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
